Terms & Conditions

These Terms govern access to and use of the XectiQ website, digital platform, franchise services, student services, certification systems and related facilities.

1. Introduction and Acceptance

These Terms and Conditions (“Terms”) constitute a binding agreement between XectiQ Computer Education Pvt. Ltd. (“XectiQ”, “Company”, “we”, “us” or “our”) and each person or entity that accesses, registers for, or uses the XectiQ website, platform, dashboard, franchise network, student services, certification services, verification services or any related facility (collectively, the “Services”).

By creating an account, registering as a centre, enrolling as a student, making a payment, accessing a dashboard, or otherwise using any Service, you acknowledge that you have read, understood and agreed to be bound by these Terms and all policies incorporated by reference.

If you do not agree to these Terms, you must not access or use the Services.

2. Nature and Scope of Services

XectiQ operates a computer education and franchise-support network that provides digital learning administration, training, student management, examinations, certification, verification and operational support to authorised centres and students across India.

Course listings, centre information, student records, academic data and supporting documents may be submitted by registered centres and may be reviewed, verified, approved, corrected, rejected, suspended or removed by XectiQ where required for operational, compliance, security or quality-control purposes.

Nothing on the platform shall be construed as creating any governmental, university, statutory or regulatory recognition unless such recognition is expressly stated in writing by the competent authority.

3. Eligibility and Account Registration

A person registering for an account must have the legal capacity to enter into a binding arrangement or must act through a parent, lawful guardian, proprietor, authorised representative or other person legally competent to provide the required consent.

Where an account is created on behalf of an organisation, institute, franchise centre or business, the person creating or operating the account represents that they have authority to bind that entity to these Terms.

4. User Responsibilities

Every user shall:

  • provide complete, accurate, current and verifiable information;
  • maintain the confidentiality of usernames, passwords, OTPs and security credentials;
  • remain responsible for activity carried out through their account;
  • notify XectiQ promptly of suspected unauthorised access or security incidents;
  • avoid sharing credentials, impersonating another person or misrepresenting authority;
  • comply with applicable law, platform instructions and XectiQ operational policies.

Fraud, false data submission, credential misuse, unauthorised access or any attempt to manipulate platform records may result in suspension, termination, cancellation of affected records and further legal action where appropriate.

5. Authorised Centre Requirements

An applicant or operating XectiQ centre must, at minimum:

  • maintain at least five working computers;
  • maintain approximately 150 sq. ft. or more of operational space;
  • submit genuine institute, proprietor, owner and supporting-document information;
  • upload only authentic student, examination and academic records;
  • maintain the infrastructure, conduct and compliance standards communicated by XectiQ.

XectiQ may conduct verification, request documents, perform audits or inspections, seek clarifications, temporarily restrict functionality, suspend approval or revoke centre access where required standards are not maintained.

6. Platform Use and Academic Conduct

Authorised centres are responsible for ensuring that:

  • online and offline examinations are appropriately supervised;
  • malpractice, impersonation and unauthorised assistance are prevented;
  • certificates, mark sheets, identity cards and academic documents are generated only through authorised systems and workflows;
  • student and academic records are not falsified, duplicated or manipulated;
  • official branding and materials are used only for permitted XectiQ purposes.

Creation, alteration, sale, circulation or use of fake certificates, mark sheets, identity documents or verification records is strictly prohibited and may result in immediate termination and legal proceedings.

7. XectiQ Wallet

The XectiQ Wallet is an internal, points-based accounting mechanism for eligible platform services. Wallet points may be applied to services such as certificate generation, digital identity cards, student records and authorised dashboard utilities.

Wallet points are not bank deposits, electronic money, cash balances or transferable financial instruments. Unless expressly required by applicable law or a specific written policy, wallet points are non-transferable, non-withdrawable and non-redeemable for cash.

Franchise centres are responsible for safeguarding their wallet-enabled accounts. XectiQ shall not be responsible for unauthorised wallet usage caused by credential sharing, negligence or compromised account access, except to the extent liability cannot lawfully be excluded.

8. Payments, Refunds and Payment Gateways

  • Fees paid toward franchise setup, student services, platform services or wallet recharge are generally non-refundable once successfully processed, except where required by applicable law or expressly provided by a written XectiQ policy.
  • Payments may be processed through independent third-party payment gateways. XectiQ does not intentionally store full card numbers, CVV values or online-banking credentials.
  • A duplicate successful transaction may be reviewed upon receipt of sufficient evidence and confirmation from the applicable payment provider or bank.
  • A user requesting review of a duplicate payment should contact XectiQ within seven working days of the transaction.
  • Users are responsible for verifying amount, beneficiary, service and account information before authorising payment.

9. Account Deactivation, Inactivity and Termination

  • A centre requesting voluntary deactivation should contact support@xectiqindia.com with at least 15 days' prior notice.
  • An account showing no meaningful student activity, wallet use or official communication for 90 days or more may be reviewed for inactivity and may be suspended or terminated after reasonable administrative assessment.
  • XectiQ may immediately suspend or terminate an account involved in fraud, falsification, illegal activity, security abuse, misuse of intellectual property, serious academic misconduct or material breach of these Terms.

Termination does not extinguish obligations, liabilities or rights that arose before termination, including payment obligations, intellectual-property rights, audit rights and legal claims.

10. Technical Support and Administrative Access

Authorised XectiQ personnel may access centre or student systems where reasonably necessary to diagnose technical issues, maintain platform integrity, investigate security incidents, verify records, provide requested support or fulfil legal and compliance obligations.

Such access shall be limited to legitimate operational purposes and handled in accordance with applicable confidentiality, security and privacy obligations.

11. Communication Consent

By providing contact information, you consent to receive transactional, operational, registration, training, security and service-related communication through telephone calls, SMS, WhatsApp, email or other lawful communication channels.

Promotional communication may be subject to separate consent or opt-out mechanisms. Requests to discontinue promotional communication may be sent to support@xectiqindia.com . Service, security and legally required communications may continue where necessary.

12. Franchise Conduct

Every franchise partner shall:

  • represent XectiQ professionally, accurately and in good faith;
  • use official brand assets only in the manner authorised by XectiQ;
  • protect student and customer records against unauthorised access;
  • avoid unauthorised use of XectiQ materials in competing or unrelated programmes;
  • maintain accurate enrolment, academic and financial records;
  • cooperate with reasonable compliance, verification and audit requirements.

13. Data, Records and Accuracy

XectiQ uses reasonable efforts to maintain accurate platform information. However, information may originate from franchise centres, students, payment providers or other third parties and may contain errors, omissions or delays.

Users and centres remain responsible for the accuracy and legality of data they submit. XectiQ may request evidence, correct demonstrable errors, flag disputed information or restrict records pending verification.

Reported inaccuracies will be reviewed as reasonably practicable, with a target resolution period of seven working days where the issue can be verified using available records.

14. Prohibited Activities

Users shall not:

  • submit, publish or distribute unlawful, false, defamatory, deceptive or misleading information;
  • infringe copyright, trademark, privacy, confidentiality or other proprietary rights;
  • engage in hacking, credential attacks, scraping contrary to access controls, malware distribution or unauthorised system interference;
  • collect personal information without lawful authority;
  • create fake centres, fake student accounts, duplicate admissions or fraudulent academic records;
  • impersonate XectiQ, its employees, authorised centres or representatives;
  • attempt to circumvent wallet, payment, verification, permission or security controls.

15. Intellectual Property and Trademark

The XectiQ name, XectiQ® trademark, logos, software interfaces, website design, course presentation, documents, templates, graphics, text, verification formats, training materials and other proprietary content are owned by or lawfully licensed to XectiQ unless expressly stated otherwise.

No content may be copied, reproduced, republished, sold, distributed, modified, reverse engineered, commercially exploited or used to create confusingly similar services without prior written authorisation, except to the extent such restriction is prohibited by applicable law.

A franchise licence or platform account grants only the limited right to use approved XectiQ materials for authorised XectiQ operations during the period of valid authorisation. It does not transfer ownership of intellectual property.

16. Third-Party Services and Links

The Services may rely upon or link to third-party payment gateways, communication providers, hosting infrastructure, mapping tools, video platforms or other external services. Such third parties operate under their own terms, policies and technical controls.

XectiQ is not responsible for third-party content, independent service outages, external privacy practices or acts outside XectiQ's reasonable control.

17. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. XectiQ does not warrant that every Service will be uninterrupted, error-free, continuously available, suitable for every user's particular purpose, or free from all defects or external disruption.

Nothing in these Terms excludes warranties or statutory rights that cannot lawfully be excluded.

18. Limitation of Liability

To the maximum extent permitted by law, XectiQ, its directors, officers, employees, authorised representatives and affiliates shall not be liable for indirect, incidental, special, punitive or consequential loss arising from use of or inability to use the Services, including loss of profits, goodwill, business opportunity or data.

This limitation does not apply to liability that cannot be excluded or limited under applicable Indian law.

19. Indemnification

To the extent permitted by law, a user, centre or franchise partner responsible for a breach of these Terms agrees to indemnify and hold XectiQ harmless from reasonable claims, losses, liabilities, penalties, costs and expenses arising from that party's unlawful conduct, fraudulent records, intellectual-property infringement, misuse of student information, unauthorised representation or material breach of its obligations.

20. Modification of Services and Terms

XectiQ may add, modify, suspend, replace or discontinue features, workflows, policies or Services where reasonably required for security, compliance, technology, business operations or service improvement.

XectiQ may amend these Terms from time to time. Revised Terms will be published with an updated effective date or otherwise communicated where required. Continued use of the Services after the revised Terms take effect constitutes acceptance of those revisions, subject to applicable law.

21. Force Majeure

XectiQ shall not be responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, severe network or power failures, telecommunications outages, cyber incidents affecting third-party infrastructure, governmental action, labour disruption, epidemic, pandemic, civil disturbance or comparable force-majeure events.

22. General Legal Provisions

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

No Waiver. A failure or delay by XectiQ to enforce any right does not constitute a waiver of that right.

Entire Agreement. These Terms, together with applicable privacy, refund, franchise and service-specific policies, constitute the governing terms for use of the relevant Services unless a separate signed agreement expressly provides otherwise.

Electronic Records. Users acknowledge that registrations, consents, approvals, invoices, notifications and platform records may be created and maintained electronically in accordance with applicable law.

23. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Subject to any mandatory statutory forum or remedy that cannot lawfully be excluded, courts having jurisdiction in Jamshedpur, Jharkhand, India shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services.

Appendix

Code of Ethics — XectiQ Franchise Partners

To protect student interests and preserve the reputation, integrity and quality of the XectiQ network, every franchise partner is expected to comply with the following ethical standards.

1. Student Welfare

  • Provide genuine education, appropriate support and fair evaluation.
  • Maintain confidentiality and security of student information.
  • Avoid unlawful discrimination in admission, teaching or centre conduct.

2. Transparency

  • Clearly communicate applicable course information, fees and certification policies.
  • Issue only authorised system-generated and, where applicable, QR-verifiable documents.

3. Integrity in Representation

  • Use approved XectiQ branding and materials only for authorised purposes.
  • Never misrepresent regulatory approval, authority, affiliation or partnership status.

4. Data Accuracy

  • Upload verified student details and correct known errors promptly.
  • Never create fake, duplicate or manipulated profiles, admissions, marks, certificates or academic records.

5. Professional Conduct

  • Maintain discipline, courtesy and professional communication with students, staff and officials.
  • Avoid deceptive advertising, misleading claims or improper attacks on other centres.

6. Accountability

  • Cooperate with reasonable audits, inspections, support reviews and verification exercises.
  • Promptly report suspected misuse, fraudulent documents, security incidents or unauthorised brand use.

7. Compliance

  • Follow applicable XectiQ operational policies, information-security requirements and Indian law.
  • Acknowledge that material or repeated breach may lead to restriction, suspension or termination of franchise privileges.
